Civil Writ Petition No.5084 of 2013
Learned Advocate General raises a
preliminary objection
stating that there has been non-
disclosure of the material facts by
the
petitioner inasmuch as he was
even a candidate in the Vidhan
Sabha
elections of 2009, where he lost
the elections and has an axe to
grind with
the present Government. He
further submits that what is now
sought to be
read by learned Senior Counsel for
the petitioner as affidavit in
support of
the petition, has now been
supplied to the respondents.
From a perusal of the copy
supplied to learned counsel for
the
Civil Writ Petition No.5084 of
2013 : 2 :
respondents, it appears that the
petition was filed with a particular
affidavit
to which Registry raised
objections. The affidavit was
replaced by a better
affidavit, but the copy supplied to
the respondents contains the
earlier
affidavit. Even the subsequent
affidavit does not contain any
details qua the
petitioner other than stating that
the petitioner has filed various
Public
Interest Litigations.
In view of the aforesaid, learned
Senior Counsel for the
petitioner states that within two
days he will file an appropriate
affidavit and
ensure compliance with the
Maintainability of Public Interest
Litigation
Rules, 2010 forming part of
Chapter I-A(c) Vol.V of Punjab and
Haryana
High Court Rules and Orders as
elucidated in our order dated
26.07.2013
passed in Civil Writ Petition
No.15987 of 2013 (Ajaib Singh
and another
Versus The State of Punjab and
others).
The response to the affidavit, if
any, be filed within two days
thereafter.
